1. GENERAL


The general terms and conditions of "Grashka online stores and platforms" (hereinafter the online store) are drawn up in accordance with:

  • by the Consumer Protection Act (ZVPot-UPB2, ULRS 98/2004),
  • General Data Protection Regulation - GDPR,
  • recommendations of the Chamber of Commerce and Industry and international e-business codes.

The online store is managed by Graska d.o.o. (hereinafter "manager"), who is also the seller.

The general business conditions define the operation of the online store, user rights and business relations between the seller and the buyer (hereinafter also the meaningful use of the term "user").

To make a purchase in the online store, the user needs a unique username and password. The username is the e-mail address that will be used to do business with the online store. The user name and password define the user as a customer and connect him with the other entered data.

Registration is not necessarily required to make a purchase, the purchase can be made as a guest.

By registering, the user acquires the right to purchase, as well as other rights, such as notification of news and other announcements, such as advice, etc.

By registering or confirming each time, the user accepts the general business conditions and other special conditions most often associated with individual products, as well as all changes that the administrator will publish on these pages.

Users of the online store can be natural or legal persons.

The online store and natural persons regulate their mutual obligations with these general conditions.

An online store and a legal or natural person performing a profit-making activity can regulate their mutual obligations with a contract, where they define general and special conditions of cooperation, if necessary. In cases where the order is carried out by a legal or natural person engaged in profitable activity, regardless of its legal organizational form or ownership role, the provisions of the Consumer Protection Act apply to it only in cases where this is specifically stated in the Act itself.


2. AVAILABILITY OF INFORMATION


The administrator undertakes to always provide the user with information about:

  • identity of the seller - company name, registered office, registration number,
  • contact information that enables the user to communicate quickly and efficiently (e-mail and telephone),
  • essential characteristics of goods and services, including after-sales services and guarantees,
  • the availability of goods or services in the online store, which should be available within a reasonable time;
  • the user is always informed about the availability and delivery date by e-mail,

the terms of delivery of products or the performance of the service, namely at least about the possible methods, places and deadlines of delivery, all prices, which are clearly and unambiguously determined by showing the price structure - net price of the product or service, value added tax and delivery costs, payment methods, validity offers, about the deadlines in which it is still possible to withdraw from the contract and the conditions for withdrawal, as well as the possible costs of returning the goods, complaints and appeals procedures.


3. THE USER


Each registered user has his own username and password, with which he introduces himself. The password is confidential and known only to the user.

The user is obliged to ensure that only he or a person authorized to act on his behalf will act on his behalf and with his password.

Upon registration, the user must enter the following personal data:

  • name and surname,
  • address and place of residence,
  • address and place of delivery, which may be different,
  • email address,
  • a username that is the same as an email address,
  • password in hidden form.

The administrator is not responsible for the accuracy of the data entered by the user during registration.

By registering, the user agrees to receive notifications related to his order or system notifications. Upon registration, the user can choose to receive notifications about special benefits and promotions, new product launches and potential prize games. The manager of the online store ensures compliance of receiving notifications with the regulations governing the protection of personal data and the consent of the user to receive informative notifications.

The user can request the deletion of personal data at any time, if the mutual obligations arising from the purchases made have been fulfilled.



4. POSSIBILITY OF PURCHASE FOR NATURAL PERSONS


The purchase option for natural persons is possible in two ways:

  • with user registration,
  • purchases, as a guest without registration.

By clicking "Add to cart", the user guarantees:

  • that he is older than 18 years,
  • that he has not been deprived of his business capacity.


5. POSSIBILITY OF PURCHASE FOR LEGAL ENTITIES


Shopping in an online store for legal entities can be agreed by the seller and the buyer with a contract, where they define special business conditions, such as:

Method of payment - by cash upon collection, transfer to the seller's account after an offer or proforma invoice, deferred payment for legal entities with adequate creditworthiness;

  • withdrawal from the contract and
  • return of products.


6. PRODUCTS AND PRICES


Shopping in the online store in Slovenian 24 hours a day and 7 days a week. The user selects and orders products from the list of products in the online store. For each product that is offered in the online store, it is indicated whether it is in stock when it is added to the basket (Bag). Despite regularly updating the inventory status, the manager does not rule out the possibility of errors. Therefore, after placing an order, the user receives an order confirmation and other necessary information for making the purchase in his electronic account.

Prices in the online store are presented as online prices. The online price is the price that applies to online purchases within the offered payment options.

Special prices in the online store are marked. These prices are valid at the time the order is placed, or those prices are valid as they were valid at the time the order was accepted into the manager's information system.

All prices in the online store are stated in euros and include value added tax - VAT, except for products where this is specifically or otherwise stated.

The prices of products and services in the online store change. Prices are also formed on the basis of special and promotional prices. Despite efforts to provide up-to-date and accurate information, it may happen that the price information is incorrect. In this case or in the event that the price changes during the processing of the order, the seller will allow the buyer to withdraw from the purchase and at the same time offer him an alternative solution.

Delivery costs are not included in the price of the products, except when the total value of the package exceeds 40 EUR.

Free delivery thus applies to purchases over EUR 40.00.



7. CONCLUSION OF THE SALE AGREEMENT


The sales contract between the seller and the buyer is concluded each time the seller confirms the order by sending the buyer an e-mail confirming the order. From this moment, all prices and other conditions are fixed and apply to both the seller and the buyer.

The purchase contract (order) is stored in electronic form on the manager's server and is accessible to the buyer - registered user at any time in his user profile (MY ACCOUNT).

If the buyer does not settle the order within 7 working days by bank transfer, the order is automatically canceled by the seller. In the case of promotions, the buyer must settle the payment by bank transfer no later than 9:00 a.m. on the next working day.



8. METHODS OF PAYMENT


The manager enables the following payment methods with/with:

  • bank cards Mastercard, Maestro, Visa, Visa electronic, Diners, American Express
  • by transfer to the account of the manager of the online store according to the offer or proforma invoice,
  • cash on delivery.

In the case of cash on delivery, the buyer pays the costs of such shipping, which are displayed whenever this option is selected.
The administrator issues an invoice to the user - customer on a permanent medium.
In case of payment with debit or credit cards, the following conditions also apply:

  • the payer (data in the user's account) must be the same person as the owner of the debit or credit card,
  • after confirmation of receipt of the order, it is not possible to change the content of the order or the final amount of the order, except in exceptional cases in agreement with the manager of the online store.
  • We reserve the right to refuse the order if the customer who ordered the products during the promotional period did not make the payment by bank transfer on time. We will only consider payments made by the buyer by the next business day (by 9:00 a.m.) after the end of the campaign. Any subsequent payment will be refunded.


9. COOKIES


What are cookies and why are they needed?

A cookie is a short text that a website sends to your browser when you visit it. In this way, the website recognizes you, remembers information about your visit and provides you with a friendly and simpler online service. With the help of cookies, we adjust the content on our website, remember your preferences and record your visit to our online store. Browsing our online cookie store is more pleasant, faster and more efficient.

At the beginning of the visit, each visitor receives a cookie for identification and monitoring of the shopping basket. Provider Graska d.o.o. on the website www.grashka.co uses its own cookies, which are absolutely necessary for the functional and safe operation of the website. The user is aware of this during the first visit.

Cookies are stored in the server's memory only for the duration of the visit and are deleted after one hour of inactivity, while permanent cookies are stored on the visitor's computer.


10. SUBMISSION, CONFIRMATION AND PROCESSING OF ORDERS


The customer can place his order every day of the year in the online store, unless it would not work due to force majeure, otherwise he does it by adding products to the online cart. The customer can choose and order products from the list in the online store. All products in the online store are available to customers until stocks are sold out.  The customer buys in the online store by adding or removing products to his "shopping basket" as desired. Before final confirmation of the order by clicking on the "Complete purchase" button and proceeding to payment, the buyer can make a final review and any changes to the order by returning to the details of his shopping cart.



10.1. Order Confirmation


Confirmation of the order by the customer takes place in the following steps:

  • check the type of products, quantity and amounts of all ordered products in the shopping basket;
  • chooses a payment method;
  • submit your order by clicking the "Complete purchase" button.

By placing an order, the buyer confirms his agreement with the general business terms and conditions and unconditionally accepts them in their entirety. The distance sales contract between the buyer and the provider is concluded when the buyer confirms the order. It is currently concluded only in the Slovenian language. After confirmation of the order, it is final and submitted and accepted into the provider's information system.


​10.2. Order processing


The administrator undertakes that each order will be processed on the same day or after the payment has been made. If this is not possible for any reason, the manager will inform the customer.

The manager prepares the goods, sends them to the delivery address chosen by the user and informs him about this by e-mail. It also instructs the customer about procedures related to product returns, delivery delays and complaints.

The manager ships the products every working day from Monday to Friday. Delivery time is 1 to 5 days.

Orders placed from Monday to Friday by 3:00 p.m. will be shipped the same day (if the product is in stock). Orders placed after 3:00 p.m. will be processed the very next day. Orders placed over the weekend will be processed on Monday.

The contractual partner GLS Slovenia takes care of the delivery.



10.3. Order status


Registered users can monitor the order status in the online store. The order statuses are as follows:


  • order placed
  • order accepted,
  • order confirmed/rejected/(partially) cancelled,
  • products in delivery,
  • order completed.
Submitted orders are processed during the manager's working hours according to the order of submitted orders or according to the planned time slots for receiving the goods.


​10.4. Restrictions on the sale of products


The manager may limit the scope if the quality department determines that the products are not safe or acceptable for sale, or if the product is determined to be non-compliant.


11. ACCEPTANCE SITES


The administrator enables personal collection of ordered goods at collection points:

When placing an order, the user indicates the pick-up location, if he has not chosen delivery by a delivery service.

Personal collection is possible at our production in Velenje at the address PE Grashka Production, Štrbenkova cesta 5, 3320 Velenje, within the working hours of the store, from Monday to Friday from 8:30 a.m. to 3:30 p.m.

In the case of personal collection, there are no costs associated with product delivery.

13. RETURN OF GOODS, COMPLAINTS AND WARRANTY


   13.1. Return of goods


Pursuant to Article 43 of the Act on Consumer Rights (ZVpot-UPB, ULRS 114/2006), the buyer cannot return goods that are not suitable for return due to health protection or hygiene reasons or that are sealed and the buyer opened the seal after delivery. This rule does not apply only in the event that there was an error on the part of the manager and the products were not used or opened. The buyer is responsible for the reduction in the value of the product, if the reduction is the result of conduct that is not absolutely necessary to determine the nature, properties and functioning of the product. Unfortunately, returns and complaints about masks are not possible.



   13.2. Complaints


The buyer can withdraw from the purchase in the event of a complaint, when the properties and appearance deviate significantly from the description in the online store. The buyer reports the complaint to the e-mail address of the manager of the online store shop@grashka.co. The manager of the online store will start resolving the complaint after notification.

In the event of a complaint, the buyer must return the goods undamaged and in the same quantity, unless they are destroyed, damaged, lost or their quantity has decreased through no fault of the buyer himself.

The manager does his best to ensure that the data in the online store is up-to-date and correct. Nevertheless, images, contents and the products themselves may be changed by the suppliers, so there may be minor differences in the actual delivered products. Therefore, product complaints based on images alone are not possible.



   13.3. Warranty


The products have a warranty if it is stated so on the warranty card or on the invoice. The guarantee is valid if the instructions on the guarantee sheet are followed and upon presentation of the invoice. The warranty periods are indicated on the warranty sheets or on the invoice.

Information about the warranty, if it exists, is also listed in the product description in the online store. If there is no warranty information, the product does not have a warranty or the information is currently unknown. In the latter case, the buyer can contact the manager.


14. PRIVACY AND SECURITY


The administrator undertakes to process the collected user data exclusively for the purposes of operating the online store and not to pass it on to third parties, except in cases where there are legal grounds for such conduct, for example in case of suspicion of online fraud. By registering, each registered user consents to the storage and processing of personal data for the purposes of order fulfillment and order-related and necessary communication.

If, upon registration, the user gives explicit permission for the processing of data for the purposes of direct marketing and the study of purchasing habits, this data may also be used for these purposes.

The administrator stores personal data about users - buyers, which they enter at the time of purchase, for 2 years, and for registered users, all mandatory data and optional data that they entered during registration. In addition, the manager keeps:


  • IP address,
  • delivery addresses,
  • telephone number for the case of delivery,
  • time and date of registration and
  • any communication between the administrator and the user.
  • We only provide the delivery service with the information absolutely necessary for delivery, namely:
  • first and last name of the user,
  • delivery address and
  • contact telephone number.


The user himself is also responsible for the protection of personal data, namely by ensuring the security of his username and password and the appropriate software protection of his computer or smart device.

The administrator can use the data in an anonymized and aggregated form for the purposes of statistical analysis and optimization of the online store.

The manager of the online store has an information security system in place, which includes technical, procedural and organizational measures.


15. DIRECT COMMUNICATION


If the user wants to communicate directly with the manager of the online store, he can call the phone number +386 (0)51 373 079. For help and additional information, the user can also use the e-mail address shop@grashka.co.

The manager will contact the user via e-mail in the form of informative e-mails, if the user has given his consent. Such messages will contain:

they will be clearly and unequivocally marked as informative messages and their content will not be an inducement to purchase, the sender will be clearly visible, the possibility to unsubscribe from receiving such messages.

The administrator will permanently consider the user's opt-out from receiving advertising messages.



16. USER RATINGS, OPINIONS AND RECOMMENDATIONS


Ratings, opinions and recommendations of users (hereafter opinions) and product reviews are one of the important contents of the online store, which are intended to better inform the user community. The manager allows only registered users of the online store to post opinions.

By submitting an opinion, the user expressly agrees to the terms of use of his opinion and allows the administrator to publish part or the entire text in all electronic and other media.

The administrator reserves the discretion to review and publish opinions. The administrator does not allow the publication of opinions that are in any way offensive or otherwise inappropriate, and do not present information about the products or services of the online store that would be useful for users.


17. LIMITATIONS OF LIABILITY


The administrator has the option of withdrawing from the contract only if an obvious error is found. According to the Code of Obligations, an obvious error is defined as a significant deviation of the product's properties and all mistakes that are considered decisive according to the customs of the trade or according to the intention of the customers and which, in the case of behavior, the manager would not approve or conclude a sales contract. This includes obvious pricing errors.

The administrator reserves the right to change the general conditions of business. Changes to the general terms and conditions of business are effective from the date of publication in the online store.



18. COMPLAINTS AND DISPUTES


The administrator respects consumer rights and operates in accordance with the Consumer Protection Act. The manager of the online store does his best to ensure the satisfaction of the users, but he cannot completely avoid their dissatisfaction, which most often manifests itself in the form of a complaint or reclamation.

The manager will try to resolve all disputes amicably without an out-of-court consumer dispute resolution provider.
